By accessing or viewing any portion of the TRADING123.NET web site, or upon subscription to any of our services, you acknowledge that you have read, understood and agree to be legally bound by the terms of our disclaimer which is subject to change without notice. You agree to hold TRADING123.NET completely harmless as a result of reading this web site or newsletter or by accessing our chat or mentoring rooms. You understand that all sales are final and there are no refunds.

Payments: We accept payments by paypal that is truly trusted and secure service we have used for over past 4 years and have not had one issue with fraud with them, its 100% safe and secure. We do not do wire transfers of any kind. Payment can also be made by check, once funds cleared software or item purchased will be sent.

DVD Software Sales & Seminar Sales: NO REFUNDS

All software sales are final ! There are no returns or credit once the order has been placed and your credit card billed. You may not return the product and demand a refund, as you could of easily copied the software which is also illegal. You can not change your mind few days later and say I want to cancel the order, once your submit the order form to us and your credit card is billed all sales are final ! NO REFUNDS. If the product is damaged and not working you must send us back the defective DVD and we will issue you a fully working DVD. This has yet to happen on any of our orders. As the "Shorting Stocks DVD" is available to view online. If you are attending one of our seminars note that once you order and the credit card or pay pal account has been billed there are NO REFUNDS.

Fees and No Refund Policy. All software, seminar, chat room, or newsletter fees will be charged to your credit card or paypal account in order to use are services, or subscribe to our newsletters. You understand and agree to pay the fees stated upon ordering. You agree to pay the fees associated with the use of the www.trading123.net  and its services by providing us with a valid credit card or through pal pal account. You hereby certify that you are the authorized user of the credit card and that we take credit card fraud and non-payment very seriously. We may work with law enforcement agencies and private parties to address these issues if and when they occur. All purchases are Final ! Trading123.Net enforces a 'No-Refund Policy' and will not refund fees for any membership, mentoring, newsletter or software or seminar purchase. Once you ordered a service you agree to pay in full and there are no partial refunds for any reason. Any charge-backs resulting from a purchase that falls under the 'No Refund Policy' that are not reversed will be sent to a collection attorney for immediate processing and will incur a $75.00 charge in addition to the disputed amount per disputed item, and we are consumer reporting agency and with your name and address will be able to get you SSN Number and will put the amount on any unpaid or returned or cancelled order on any customer's credit report. This will affect your credit and the ability to get credit, as you can see we are serious about are business. You understand that, unless otherwise agreed to in a writing by Trading123.Net, you will be charge fees as published on the Trading123.Net at the time each search is ordered.. If you suspect that unauthorized use of your credit or your account is taking place, you must notify us immediately.

Software Return Policy: Trading123.Net guarantees that all software packages or DVD's  sent to the customer via download or by mail contains all of the items ordered by the customer for the price they paid and the item they ordered and that all items are in working order. All DVD's and software is fully tested and proven to work before it is sent out. For any reason If the item is damaged or does not operate properly, the customer must contact Trading123.Net  within 15 days of receiving the merchandise and a new DVD or software file will be sent if damaged. There are" NO REFUNDS " or "I Changed my MIND" don't want it anymore no excuses will be accepted you bought it you own it forever.

Software Products: All our software products are distributed and licensed as is. There are no warranties, guarantees or promises of any kind as to their performance, as each trader has a different level of education so no guarantees can be made that you will get the same results we do. In no event shall Trading123 be accountable for any loss of data, financial loss, emotional loss from our software. NinjaTrader software purchases can download the software and install on two machine ID's provided by the customer.

Limitations on Use. By subscribing to TRADING123.NET newsletter or chat room you AGREE that the information contained within the newsletter is for a single purchasers use only and your email address. It may not be copied, redistributed, published, broadcast, circulated or emailed, to any friends, clients, investors, or sold  to any third party without the written consent of TRADING123.NET. The daily newsletter is not for swing trades, and is based on technical analysis, and to be used for educational purposes for intraday paper trades. Our entry and exits points may vary from your results as the market moves quickly.  You also AGREE not to use any information in the newsletter for any unlawful purpose. Any violation will result in you subscription being cancelled, with no refund, and you will not be able to subscribe again. Past performance is no guarantee of future results. You agree to hold TRADING123.NET completely harmless as a result of subscribing to the newsletter. TRADING123.NET reserves its right to make changes to the Membership Fees at any time it seems necessary. And may cancel or refuse any membership it deems necessary. Any competing chat room moderators or members are not allowed access to our chat room. Each individuals success at day trading depends on there education, background, dedication to learn, desire and motivation to be successful. If you do not take the time to learn the stock market it will be hard for you to continually make money.

Software Purchases, Pay Pal Membership, and Cancellation

Once you have purchased a product through paypal it can take 1 to 3 business days to verify the payment. This is true if your new to paypal and haven't been verified by them. Once payment is cleared which recently has been within 24 to 36 hours we will send you the software.

Our Newsletter & Chat Room membership is handled by Pay Pal. The subscription rate is $100 a month for the daily newsletter which is published each morning the market is open. Chat room access is $250 a month. The fee is billable on a reoccurring basis, or month to month and will renew every 30 days. It is the MEMBERS responsibility to know the expiration date of there monthly MEMBERSHIP. This can be easily checked by logging into your Pay Pal account. To cancel your membership you must log into your Pay Pal Account and cancel through Pay Pal. Your membership is your responsibility and we can not keep track of all members and there membership as it is to time consuming and that's why we set it up with paypal.. In the event that I cancel my MEMBERSHIP prior to my current subscription period being used up for the month, I am not entitled to any credits or refund for my unused MEMBERSHIP term. The membership is good for the entire 30 days so if you cancel ahead of time will not affect your daily access to the chat room or newsletter membership. If I cancel my membership and I wish to rejoin the site, I understand I will have to reapply through the Pay Pal for the subscription I choose. Reactivation of a canceled membership is based on the discretion of TRADING123.NET  and should a MEMBERSHIP reactivation be turned down, TRADING123.NET  is under no obligation to provide a reason for the denial of MEMBERSHIP. We do not offer any refunds on membership, all sales of DVD's are final and are not returnable under and circumstances. If you get a defective DVD by chance, a new DVD will be sent to you at no extra cost. DVD material is viewable on line in the membership area so there is no excuse for not being able to view the DVD info.  All training and or mentoring is also handled through Pay Pal and is billed at a one time set fee for the service you order and there are no refunds as stated in our refund policy above.

Credit Card Orders and Cancellation

When paying for newsletter or chat room membership by credit card your credit  card will be billed for upon ordering membership. The membership will renew every 30 days and your credit card will be billed the amount for membership at that time. If you wish to cancel your membership at any time simply email us at info@trading123.net with your name and will will not re-bill the credit card when it comes up for monthly renewal. Your membership will remain in effect for the full 30 days. Again there are no refunds on any memberships.   

Delays in Services

TRADING123.NET or any of its employees, directors, representatives will not be liable for any loss or liability resulting, directly or indirectly from delays or interruptions due to electronic or mechanical equipment  failures, telephone or internet failure or connections problems, defects, weather, snow, ice, rain,  fire, power outages, acts of nature, acts of war, explosions, acts of God or other like causes.  TRADING123.NET shall have no responsibility to provide you access to the chat room or newsletter during any interruption, and is not liable for any delays of service caused will accessing the web site. All members must understand that if a Moderator is not in the Trading room due to illness, holiday or other reasons, certain services may not be available that market day.
